General Terms and Conditions

For terms of the contract now and in the future, the company Pelecanus SAS with Nit. 901012952-7 and RNT. 51402 will be called “Pelecanus”, and the person who buys and acquires the professional services of the company will be called “the customer.” Since the contract will be executed and executed in Colombia, the Colombian laws will be applicable. Place of jurisdiction will be Colombia.

The client establishes that he / she knows and accepts these terms and conditions at the moment of contracting Pelecanus, without option to negotiate or to change totally or partially this contract. By using our website and making a reservation, the customer accepts these terms and conditions, as well as the terms and conditions of our suppliers that are applicable. Whoever performs the reservation and purchase process with our company represents all the persons that will be part of the service, which will also be governed, both by the terms and conditions, and the Colombian laws and is responsible for informing himself of the terms, conditions and laws applicable to the contracted service. As a client, it is assumed that you are of legal age and capable of acting to use this website and therefore to accept the legal and economic obligations and responsibilities that it entails.

As a condition of use of this website, the user and / or client will guarantee not to carry out any prohibited or illegal activity established as such by the laws, as well as by the terms, conditions and requirements expressed in this section. If so, the client is aware and accepts that the consequences can range from cancellation of the reservation or purchase, to the payment for the costs generated by the faults committed.

The client agrees to use the website responsibly and is responsible for the correct use of it. Also for third parties that use it on his behalf, and that all the information that he or another person sends us by any means will be correct and true.

This website may contain links to other pages operated by third parties that are independent of Pelecanus. The company has no control or responsibility for its contents. The inclusion of these websites on the page does not imply that Pelecanus has a commercial, legal or personal relationship with them. We suggest reading the terms, conditions and policies of each of these sites, as they may vary.

Privacy and Treatment of Personal Data

The personal information provided to Pelecanus will be handled in a responsible manner, respecting the right of confidentiality. However, this information must, in some cases, be shared with service providers (hotels, operating agencies, transport agencies, etc.) when necessary.

The data that the client provides will be safeguarded by the company using the means at its disposal to guarantee a good use of the same in the natural and complementary activities that our business demands. The information will not be provided to third parties outside the activities in which the client is part, but only and exclusively to those involved in providing the contracted service.

The customer must send their personal information at least 60 days before the start date of the trip (together with the final total payment of the price of Pelecanus’ services). In case the requested information has not been delivered 30 days before, Pelecanus reserves the right to cancel the trip. Fees corresponding to the cancellation will in any case not be reimbursed.

Responsibilities

Pelecanus acts mainly as an intermediary between the customer and the entities or persons responsible for the provision of the different services that are contracted through the company: rent of vehicles, guides, restaurants, hotels, airlines, sports, land, sea and river transport or any other service not directly provided by the company. As a travel agent, Pelecanus will assist the customer as much as possible in resolving any type of inconvenience, but complaints should be addressed first to the service operator being responsible on site and then Pelecanus. Likewise, the costs that the suppliers change in an extemporaneous manner, after having made the total payment, will be the responsibility of the client. These costs may be changed due to the increase in the price of fuel, new taxes, foreign exchange, among others. Pelecanus will notify the customer of such changes as soon as it has been informed about them.

Pelecanus is not liable for loss or theft of personal belongings, damages, accidents, natural disasters, illness, injuries, moral or physical damage, death or other calamity due to weather, protests, delays, quarantine or other causes outside the control of the company. The extra expenses incurred due to this type of disaster will be supplied by the client, as well as the oversold air tickets, delays, cancellations, rescheduling, or other inconvenience with flights.

If any of the situations or force majeure arises, we will work and strive to find a solution and help the client to get around the situation in the best possible way. However, Pelecanus will not be responsible for the additional costs that these problems generate. Therefore, we reserve the right to modify itineraries, activities, transportation, programs and routes without prior notice if there is a force majeure.

In general, our prices do not include (unless other arrangements are officially expressed): Any expenses made to and from the destination during transfers, meals not specified in the service description, alcoholic beverages, telephone calls, souvenir purchases or other personal objects and services not specified in the package description.

Pelecanus is not responsible for damages, expenses, wrong information, or any other consequences resulting from errors navigating on the website.

CSEC

Pelecanus is against sexual exploitation of children and adolescents in accordance with law 679 of August 3, 2001, issued by the Congress of the Republic of Colombia, and by means of which “… a statute is issued to prevent and counteract exploitation, pornography and sex tourism with minors, under Article 44 of the Constitution. ”

All persons must denounce, prevent and prevent the exploitation, publication, use and dissemination of images, audiovisual archives, documents or links related to any type of pornographic material or sexual activities alluding to minors. These activities are punishable by Colombian law and represent a crime.

Reservation

To make the reservation more than 60 days before the trip, a payment of at least 50% of the total value of the service must be made. The payment of the surplus must be paid 60 days before the start. If the reservation is made less than 60 days before the first day of the trip, the entire price must be paid. In some cases, a charge of more than 50% of the total price will be made due to different causes (high seasons, holidays, requests from our suppliers, etc.). In such cases, Pelecanus will let the customer know in advance.

The reservation is considered valid and accepted at the moment Pelecanus sends an email or confirmation message through one of its official means. It is at this point that the contract between the customer (you) and the company (Pelecanus) is created.

Pelecanus reserves the right to cancel the service if the agreed payment is not made within the specified time frame.

All airline tickets are subject to price increases even after they have been purchased. This may be due to the change of foreign currency, fuel price, new taxes, the combination of these reasons or other causes beyond Pelecanus’ power, therefore, the customer agrees to make payments in such cases.

Changes to the reservation

Pelecanus will always seek to help the client in modifying some of the characteristics of the reservation previously made. However, the company does not guarantee to be able to fulfill the requirements of the client, since it depends on each of the suppliers and their policies.

If it is possible to make the change that the client requests, the client should be responsible for the extra costs that the change caused. Changes are subject to availability.

Methods and payment process

We do not accept payments from third parties. The person who owns a credit card with which it is paid must be one of the travelers.

Payments must be made at the times agreed in these terms and conditions, except for a different agreement between the parties with written support. Payments can be made with Visa, Master Card or American Express credit cards through our website. Pelecanus SAS will charge 5% of the total purchase price to cover additional fees for use of the credit card.

Once the payment is made, we will carry out the respective checks to prevent all types of fraud and thus protect both parties, both Pelecanus and the customer. We may require extra information such as copy of passport or address to confirm authenticity in payments; for this we will require a quick response.

Credit card handling costs are non-refundable.

We reserve the right to refuse check payments as a method of payment.

Cancellation process

If for any reason the customer wishes to cancel the reservation already acquired, in any of the cases and due to costs incurred by the company, the amount that will be returned to the customer decreases the closer the start date of the trip, as follows:

  • From 60 to 45 days before the start of the trip, 80% of the total cost of the package is returned.
  • From 44 to 20 days before the start of the trip, 50% of the total cost of the package is refunded.
  • From 0 to 19 days prior to the start of the trip, there will be no refunds.

All cancellations must be made by written means and, depending on the cancellation policies of our suppliers, the amounts mentioned above may vary.

Medical and insurance conditions

The customer is required to notify the company in writing of any kind of illness, disorder, pregnancy, disability or other physical impairment that affects one of the activities to be performed during the trip or requires special attention.

It is advisable to consult a doctor before making a reservation to make sure that you are in good physical and mental condition.

Pelecanus recommends the acquisition of a travel insurance that meets your needs and is valid over the total travel time.
